These Terms & Conditions ("Terms") govern your access to and use of the website, mobile applications and services offered by Phoenix Green Valley ("Phoenix Green Valley", "we", "us" or "our"), including the browsing, enquiry, booking and allotment of managed agri-farm land plots. By accessing our website or booking a plot through us or our authorised agents, you ("you", "the Customer") agree to be bound by these Terms.
1. About our services Phoenix Green Valley markets and facilitates the booking and allotment of agricultural / farmland plots within developed and managed layouts. Plot details, dimensions, pricing, images and layout maps shown on our website or app are indicative and may be updated from time to time. Nothing on the website constitutes a binding offer until a booking is confirmed and accepted by us in writing.
2. Eligibility You must be at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872 to book a plot or create an account. You agree to provide true, accurate and complete information and to keep it up to date.
3. Enquiries, bookings and holds You may express interest in a plot through the website, app or an authorised agent. On booking, a plot may be placed on a temporary "hold" for a limited period to allow completion of documentation and payment. A hold does not constitute ownership or a guarantee of allotment. If the required booking amount is not received and verified within the hold period, the hold may lapse and the plot may be released for sale to others.
4. Payments and verification Booking and instalment payments may be collected through our authorised agents or directly by us. Every payment is recorded against your booking and is treated as provisional until it is verified and approved by Phoenix Green Valley. A booking is confirmed, and subsequent stages (such as agreement, balance payment and registration) are unlocked, only after the corresponding payment has been approved. Please obtain and retain an official receipt for every amount you pay, and pay only into accounts officially notified by Phoenix Green Valley.
5. Pricing, taxes and charges All prices are quoted in Indian Rupees (INR). Prices are exclusive of applicable taxes, registration charges, stamp duty, documentation, maintenance and any statutory levies unless expressly stated otherwise. Applicable taxes (including GST, where relevant) and government charges are payable by the Customer. We reserve the right to revise prices of unbooked plots without prior notice.
6. Allotment and registration Allotment of a specific plot is confirmed through a written agreement after the required payments are approved. Registration and conveyance of the plot will be carried out as per the agreement and applicable law, subject to the Customer completing all payments, KYC and documentation. Possession and registration timelines are indicative and may be affected by statutory approvals and circumstances beyond our control.
7. Cancellation and refunds Requests to cancel a booking must be made in writing. Refunds, if any, will be processed as per the cancellation terms set out in your booking agreement and may be subject to deduction of booking charges, administrative costs, taxes already remitted and amounts payable to authorised agents. Statutory charges already paid to government authorities are generally non-refundable.
8. Managed-farm and maintenance services Where a plot is offered with managed-farm development, maintenance or allied services, the scope, duration and charges for such services will be described in a separate service schedule or agreement. Continuation of such services may require payment of recurring maintenance charges.
9. No assurance of returns Agricultural land and farmland-based plots are long-term holdings whose value depends on many factors outside our control, including market conditions, weather, crop performance and government policy. Phoenix Green Valley does not promise, guarantee or assure any specific appreciation, yield, rental, buy-back or financial return on any plot. Any illustration of potential returns is hypothetical and must not be relied upon as a commitment.
10. Authorised agents and channel partners Our agents and channel partners are authorised only to facilitate enquiries, bookings and the collection of payments into officially notified accounts. They are not authorised to make representations, promises or commitments on our behalf beyond what is stated in our official documents. We are not responsible for any unauthorised representation or collection. Please verify every transaction through our official receipts and contact channels.
11. Customer obligations You agree to use our website, app and services only for lawful purposes, to provide valid KYC and identity documents, to make payments only through official channels, and not to misuse, disrupt or attempt unauthorised access to our systems.
12. Intellectual property All content on the website and app, including the Phoenix Green Valley name, logo, text, graphics, layout maps and images, is owned by or licensed to Phoenix Green Valley and is protected by applicable intellectual-property laws. You may not copy, reproduce or use such content without our prior written permission.
13. Disclaimers The website, app and their content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding accuracy, availability or fitness for a particular purpose. Plot images and layout plans are for representation only.
14. Limitation of liability To the maximum extent permitted by law, Phoenix Green Valley and its directors, employees and agents shall not be liable for any indirect, incidental, special or consequential loss, or any loss of profit or anticipated savings, arising out of or in connection with your use of our services. Our aggregate liability in any matter shall not exceed the amounts actually received by us from you in respect of the relevant booking.
15. Indemnity You agree to indemnify and hold harmless Phoenix Green Valley and its representatives against any claim, loss, liability or expense arising from your breach of these Terms, your violation of any law, or any misrepresentation made by you.
16. Governing law and jurisdiction These Terms are governed by the laws of India. Subject to any binding arbitration or grievance process, the courts having jurisdiction over the location of our registered office shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
17. Changes to these Terms We may update these Terms from time to time. The revised Terms take effect when published on this page. Your continued use of our services after changes are published constitutes acceptance of the revised Terms.
